Commonwealth v. Garey Lee Janet Lee Subrena Service
On 02/09/2005, Janet Lee of Randolph MA purchased a 1997 Honda in Lynn for $3,195.00 on behalf of her husband Garey Lee of Randolph MA who was out of the country at the time. Janet Lee owned a 1966 Pathfinder and Garey Lee owned 1993 Toyota at this time. On 02/10/2005, Janet Lee transferred her husband’s Liberty Mutual Insurance Company policy from Toyota to the Honda attesting to a purchase price of only $2,000.00. Janet Lee also indicated that the Honda would be garaged in Randolph and the only two operators were she and her husband. The next day on 02/11/2005, Subrena Service of Lynn, the daughter of Janet Lee obtained two parking stickers for the Honda, one at her residence in Lynn and the second at her school in Lynn. Shortly thereafter Service had a radio and security system installed in the Honda by a Lynn firm. Later the Honda had a safety and emissions inspections in Lynn. In January of 2006, Garey Lee returned home and shortly thereafter purchased and insured a third vehicle, a 1995 Cadillac Deville. On 07/02/2006, Service reported the theft of the Honda while it was parked overnight at her residence to the Lynn Police Department. Garey Lee then made a claim against his Liberty Mutual policy. Garey Lee and Service made statements, etc. that all the keys were accounted for, the vehicle had been locked, the alarm had been set, and they had no knowledge of any suspects. Garey Lee and Service made numerous statements that the Honda was garaged in Randolph and that Service was not a regular operator of the Honda. Subsequently Garey Lee received payment of $4,482.75 from Liberty Mutual. On 08/17/2006, the Honda was recovered in Lynn 1.71 miles from Service’s residence. There was no forced entry and the ignition was intact. Liberty Mutual then had a forensics examination conducted of the Honda. The doors and ignition locking systems were found to be intact and in good working order, the security system was intact and in good working order and it was found that it would have been necessary to use the remote to deactivate the alarm and the key to drive the car. Liberty Mutual and Insurance Fraud Bureau investigations revealed Service recently had been terminated from her employment and was in debt. The investigations of the Liberty Mutual Insurance Company, the Lynn Police Department and the Insurance Fraud Bureau of Massachusetts produced substantive and unresolved inconsistencies and discrepancies. On 05/23/2008, Garey Lee, Janet Lee and Subrena Service were arraigned on insurance fraud related charges at the Lynn District Court. On 05/19/2009, a jury trial began on Garey Lee and Subrena Service. The charges against Janet Lee earlier had been Dismissed. On 05/20/2009, the jury found Garey Lee Not Guilty and found Subrena Service Guilty. Service was sentenced to six months in the House of Correction, but that sentence was suspended for one year. She was also ordered to pay restitution.
