Juan Guerrero
On 03/14/2008, Juan Guerrero 27 years old of Lynn, Evelyn Cardona Fuentes 41 years old formerly of Lynn, and Franshesca Valdes 21 years old formerly of Lynn were arraigned at the Lynn District Court. Aracelis Capellan 37 years old of Jamaica Plain did not appear and a warrant for her arrest was issued. The charges included Filing False Insurance Claims, Conspiracy, and Attempted Larceny. The complaints allege that on 07/16/2004, Juan Guerrero and Aracelis Capellan reported they had been involved in an alleged motor vehicle crash on Boston St at the intersection of Washington St. The responding Lynn Police Department officers and emergency medical personnel noted that there was little or no damage to either vehicle. Juan Guerrero and his passengers Evelyn Cardona Fuentes and Franshesca Valdes all claimed to have been injured in the alleged crash. They later received medical treatment for their alleged injuries and made insurance claims. Aracelis Capellan and her two juvenile passengers all claimed to have been injured in the alleged crash. They later received medical treatment for their alleged injuries and made insurance claims. Liberty Mutual Insurance Company and Commerce Insurance Company initiated investigations. A damage analysis of the vehicles concluded there was no evidence to support the reported accident. Liberty Mutual and Commerce denied the claims. The insurance companies then referred to the claims to the Insurance Fraud Bureau of Massachusetts alleging insurance fraud. The Insurance Fraud Task Force of Lynn consisting of investigators from the IFB and the Lynn Police Department conducted a further investigation that resulted in criminal complaints. The prosecution is on going.
