vs Juan Larapeguero David Mercedes Omayra Clausell Carlos Peres Coni Matine
On 11/16/2007, Juan Larapeguero 34 years old of Lynn, David Mercedes 50 years old of Lynn, and Omayra Clausell 26 years old of Lynn were arraigned at the Lynn District Court. Maria Flores 37 years of Lynn, Carlos Sierra 43 years old of Lynn, Marcia Tejeda 47 years old of Lynn, Carlos Peres 25 years old of Boston and Coni Matine 51 years old of Boston did not appear and warrants for their arrest were issued. The charges included Filing False Insurance Claims, Conspiracy, Larceny, Attempted Larceny and Falsely Procuring a License. The complaints allege that on 08/26/2004, Juan Larapeguero of Lynn and Maria Flores of Lynn reported they were the operators of two vehicles that were involved in a crash on Flint St at the intersection of Walnut St in Lynn. Omayra Clausell, Marcia Tejeda, Carlos Peres and Coni Matine all claimed to have been passengers in Larapeguero’s vehicle. Juan Larapeguero, Omayra Clausell, Marcia Tejeda, Carlos Peres and Coni Matine all made insurance claims for injuries suffered in the crash. David Mercedes claimed to have been a passenger in Maria Flores’ vehicle. He claimed he had been injured and he submitted insurance claims. There was evidence that Carlos Sierra was a passenger in the Maria Flores’ vehicle. There was minor damage to both vehicles. The Premier Insurance Company and Liberty Mutual Insurance Company conducted investigations. The evidence indicated that the vehicles may have not collided with one another and that no one had been injured. The Premier Insurance Company denied the claims. Liberty Mutual Insurance Company paid some of the claims before denying the remainder. The insurance companies then referred the claims to the Insurance Fraud Bureau of Massachusetts. The Insurance Fraud Task Force of Lynn consisting of investigators from the IFB and the Lynn Police Department conducted a further investigation that resulted in criminal complaints. The case is on going.
