On June 26, 2007, at approximately 6:22 P.M., Lynn Police and Lynn Fire responded to 14 Essex Street on a report of a drowning. Upon the officers’ arrival, a neighbor was performing CPR on a 9 year-old boy. Several officers assisted with trying to revive the boy, and he was subsequently transported to Salem Hospital. Justin Gutierrez, age 9, of Lynn, was pronounced dead a short time later.

The investigation revealed that several people were swimming in a friends pool located at 14 Essex Street in Lynn. The pool was described as an in-ground pool ranging from 3 to 8 feet in depth, and the water was not clear. At some point, a 6 year-old girl began to struggle in the water, and several people came to her aid. Unbeknownst to everyone at the time, and during the commotion, a nine year-old boy also went under the cloudy water.

Approximately five to ten minutes later, it was realized that the boy was missing. After checking the yard, people entered the pool, and discovered the boy at the bottom. He was removed, and attempts were made to revive him. The boy’s mother was also present at the time of this tragic accident.
